The ifi-patent-status container includes IFI's calculated legal status and expiry dates. We provide a simple view of the current estimated status of a patent or application as well as the expected expiration date.

 IFI’s Adjusted Expiration Date and Patent Status Indicator are useful estimates, but should not be considered authoritative or final results. An attorney or the relevant patent office should be consulted for an authoritative expiration and status determination.

AttributeDescription
anticipated-expirationAnticipated expiration date is calculated according to the patenting authority and document kind and reflects the maximum life of the patent assuming maintenance fees are paid and term extensions are not in place. See Anticipated and Adjusted Expiration Dates for more information.
adjusted-expirationAdjusted expiration date contains a date calculated to reflect term adjustments made by the Australian patent office or by the USPTO under 35 USC 154. Present for AU and US only. See Anticipated and Adjusted Expiration Dates for more information.
regulatory-extension

"Yes" when true. This field appears in AU or US records when exploitation of a patent is delayed by regulatory review (e.g., FDA review) or in other patents when a Supplementary Protection Certificate (SPC) has been issued for a patent.

In the US, “Yes” may also indicate that an interim extension has been granted (PEDS code PTEI). If a PTE Certificate is not issued, the extension will not be reflected in the IFI Snapshot or the office-specific-data container. Therefore, when the regulatory-extension=Yes and there is no data in the office-specific-data/ustags container and/or no adjusted expiration date in the IFI Snapshot, we recommend investigating the status via PAIR or the USPTO Patent Center. 

terminal-disclaimer"Yes" when a notice of terminal disclaimer is present. For US pre-2001, the adjusted-expiration date may incorporate a terminal disclaimer; post-2000, the adjusted date does not include the effect of a terminal disclaimer.
ep-up-requested"Yes" when lscode:U01 has been delivered in the legal event codes for EP-B records. Indicates that applicant has filed for a Unitary Patent (UP). Once the UP is registered, a C0 record is created where annuity payments, appeals, and other post-grant procedures are tracked.
